Dana Livingston is recognized as one of the premier appellate advocates in Texas specializing in federal appellate practice. She has argued cases before the Fifth and Ninth Circuits, has participated in scores of federal appeals, and has authored several authoritative articles on federal appellate practice. She is also highly regarded for her expertise in state appellate practice, and in particular, practice before the Supreme Court of Texas.

Dana has co-authored a comprehensive article comparing state and federal appellate practice, which has been republished numerous times. Dana is uniquely qualified in this regard, having served both as Law Clerk for Judge Jacques L. Wiener, Jr. of the United States Court of Appeals for the Fifth Circuit and as the Staff Attorney for Justice Priscilla R. Owen while Justice Owen served on the Supreme Court of Texas.

Dana was recently selected by the American Bar Association to serve as the Editor-in-Chief of a multi-jurisdictional appellate practice publication by the Council of Appellate Lawyers of the Judicial Division of the ABA. She is the author of the Fifth Circuit Chapter of that book and is a frequent speaker at CLE programs.

Dana is Board Certified in Civil Appellate Law by the Texas Board of Legal Specialization.  She previously served as a member of the Civil Appellate Law Examination Commission for the Texas Board of Legal Specialization and as an Adjunct Professor of Appellate Advocacy at the University of Texas School of Law.  Dana has been selected for inclusion in 2010 Texas Super Lawyers in appellate practice, and she has been included in The Best Lawyers in America ® 2011 (Copyright 2010 by Woodward/White, Inc., Aiken, SC).

Dana graduated with honors from the University of Texas School of Law in 1990, where she was Executive Editor of the Texas Law Review. Dana also received her undergraduate degree from the University of Texas, being graduated with high honors in 1987 with a double major in Economics and Philosophy. Dana is a past Chair of the Civil Appellate Law Section of the Austin Bar Association.

Dana entered private practice with the Houston office of Vinson & Elkins LLP. Before becoming a partner with Alexander Dubose & Townsend, she managed a successful solo practice dedicated to appellate law. Dana is admitted to practice before the United States Supreme Court, the United States Court of Appeals for the Fifth and Ninth Circuits, and all Texas state courts. Dana is a Fellow of the Texas Bar Foundation.
